mécanismes à l’œuvre sont saisis dans leur application concrète. Mais l’espoir est
là, qui s’incarne dans la résistance quotidienne de ceux qui, dans les
régions
dévastées, occupent les terres et opposent le droit à l’alimentation à
la

Dans cet
ouvrage
pionnier, Christophe Golay décrit l’évolution de la protection du droit
à
l’alimentation depuis l’adoption de la Déclaration universelle des
droits de
l’homme de 1948. Il démontre ensuite comment il est devenu possible de
garantir
l’accès à la justice pour les victimes de violations de ce droit
fondamental.
Dans la première partie de cet ouvrage, Christophe Golay démontre que
les arguments
qui ont toujours été présentés contre la justiciabilité du droit à
l’alimentation sont aujourd’hui dépassés. Dans la deuxième partie, il
démontre
qu’il est possible d’avoir accès à la justice en cas de violations du
droit à
l’alimentation si ce droit est consacré, invocable et reconnu comme
étant
justiciable dans un système juridique donné. Ces trois conditions étant
réunies
en Inde, en Afrique du sud, en Argentine, en Colombie, en Suisse et sur
les
continents africain et américain, des millions de victimes de
violations du
droit à l’alimentation ont déjà eu accès à la justice.
Dr. Christophe Golay est Research Fellow à l’Académie de droit
international humanitaire et de droits humains à Genève. Il enseigne à

Economic, Social and Cultural Rights" is a new publication by
Christophe Golay, Claire Mahon and Ioana Cismas, researchers at the
Geneva Academy of International Humanitarian Law and Human Rights and
members of the team supporting Jean Ziegler's mandate at the United

Special
Rapporteur on the Right to Food from 2001 to 30 April 2008, has been
appointed
as a Member of the Advisory Committee of the United Nations' Human
Rights
Council. In his new capacity, he is responsible for the promotion and
protection of economic and social rights, and in particular the right
to food.
He began his new mandate at the United Nations on 1 May 2008.
